Terms of Sale

These terms apply to all digital products sold by AI Clarity on Gumroad ("Products"). By purchasing any Product, you agree to these terms.

1. License

Each Product includes a LICENSE file specifying the applicable license type:

The LICENSE file included with each Product is the authoritative license. These Terms supplement but do not replace it.

License Tiers

All paid Products are available in three tiers. The tier you purchase determines the scope of your license:

  • Personal — Single individual, personal or solo freelance projects. Not for use by or on behalf of an organization.
  • Commercial — Single organization, all employees and contractors within that organization.
  • Agency/Team — Agencies, consultancies, or teams serving multiple clients. Covers client projects and internal operations.

You select your tier at purchase. Using the Software beyond the scope of your purchased tier is a license violation.

Creative Commons Products

The Outreach Prompt Pack is licensed under CC BY-NC 4.0. Non-commercial use (personal learning, non-revenue projects) is permitted with attribution. Commercial use requires purchasing a Commercial or Agency/Team tier license.

2. What You May Do

  • Use the Product in your own applications and services within the scope of your license tier.
  • Modify the source code for your own use (or your organization's use, per your tier).
  • Deploy the Product as part of your own products and services.
  • Use included test suites, examples, and documentation for development and learning.

3. What You May Not Do

  • Redistribute the Product (or any portion) to anyone outside the scope of your license tier.
  • Resell or repackage the Product as a standalone product.
  • Include the Product (or substantial portions) in any product or service whose primary purpose is to provide the same core functionality as the Product itself.
  • Share source code in public repositories, blog posts, tutorials, or other public channels.
  • Transfer your license to another individual or organization.
  • Remove copyright notices, license text, or attribution.

4. Disclaimer of Warranty

THE PRODUCTS ARE PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. AI CLARITY DOES NOT WARRANT THAT ANY PRODUCT WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR COMPATIBLE WITH YOUR SPECIFIC ENVIRONMENT.

You are solely responsible for testing and validating the Products before deploying them in production.

5. Limitation of Liability

IN NO EVENT SHALL AI CLARITY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

AI Clarity's total aggregate liability under these terms shall not exceed the amount you paid for the Product giving rise to the claim.

6. Refund Policy

All Products are covered by a 30-day refund policy, no questions asked, administered through Gumroad's refund system. After 30 days, all sales are final.

7. Updates

Your purchase includes 12 months of updates delivered via Gumroad. After 12 months, you retain a perpetual license to the version you have, but are not entitled to further updates unless you purchase again or a renewal is offered.

8. Support

Products are sold as self-service developer tools. Reasonable support is provided via email on a best-effort basis. AI Clarity does not guarantee response times or resolution of issues.

9. Acceptable Use

You agree not to use any Product:

  • In violation of any applicable law or regulation.
  • To send unsolicited communications in violation of CAN-SPAM, TCPA, GDPR, or equivalent local regulations.
  • In any manner that could damage, disable, or impair AI Clarity's reputation or services.

The outreach-related Products (Outreach Prompt Pack, Outreach Safety Kit, WORM Archive) are tools for building compliant outreach systems. You are solely responsible for ensuring your use complies with all applicable laws in your jurisdiction.

10. Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full force and effect.

11. Entire Agreement

These Terms of Sale, together with the LICENSE file included with each Product, constitute the entire agreement between you and AI Clarity regarding the Products.
